Terms of service
These terms govern your use of TenderFit("we", "us", "the Service"). By creating an account or using the Service, you accept these terms. If you disagree with any part, don't use the Service.
1. What we provide
TenderFit indexes publicly-published South African tender data (via the eTenders OCDS feed and other public sources), scores tenders against a company profile you supply, and shows the results in a web application. We do not prepare, submit, or guarantee the outcome of any bid.
2. Your account
You're responsible for keeping your credentials safe and for activity that happens under your account. One organization = one company; sharing seats with unrelated parties is not permitted. You must be at least 18 to hold an account.
3. Acceptable use
Don't use the Service to scrape it, reverse-engineer it, resell derived data, or bypass usage limits. Don't upload profile content you don't have the right to use. Don't use the Service to break South African law.
4. Billing
Paid subscriptions are billed monthly in ZAR via our payment processor (Paystack). You can cancel at any time from Settings; your subscription remains active until the end of the current period. We may adjust pricing with 30 days' notice; existing subscriptions hold their price for the notice window.
5. Data + accuracy
Tender data is sourced from public feeds and reflects the state of those feeds at ingest time. We do our best to keep it fresh but make no guarantee of completeness, accuracy, or availability. Verify the full tender document with the issuing authority before you submit.
6. Availability
We aim for high uptime but the Service is provided "as is". Scheduled maintenance, third-party outages (Clerk, Neon, Paystack, OCDS feed) and force majeure can affect availability. No SLA is offered on the Starter tier.
7. Termination
You can close your account at any time. We may suspend or terminate accounts that breach these terms; in that case we'll refund any unused portion of a pre-paid subscription.
8. Limitation of liability
To the maximum extent permitted by law, our liability for any claim related to the Service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for lost bids, missed deadlines, or consequential losses.
9. Governing law
These terms are governed by South African law. Disputes are subject to the exclusive jurisdiction of the South African courts.
10. Changes
We may update these terms; material changes are notified by email or in-app banner at least 14 days before they take effect. Continuing to use the Service after that constitutes acceptance.
